PROGRAM

The Departmental Committee on Energy is established in accordance with the provisions of Standing Order 216 of the National Assembly. Its mandate as provided for in S.O. 216(5) is to inter-alia: “Consider relevant legislation and recommend enactment of laws”

Article 118(1)(b) of the Constitution provides that “Parliament shall facilitate public participation and involvement in the legislation and other business of the Parliament and its Committees.” Standing Order 127(3) of the National Assembly Standing Orders provides that “the Committee to which a Bill is committed shall facilitate public participation and shall take into account the views and recommendations of the public when the committee makes its report to the House.”

On Wednesday 14th February ,2018 the Energy Bill, 2017 and thePetroleum (Exploration, Development and Production) Bill, 2017 underwent its First Reading pursuant to Standing Order 127 (3) and are now committed to the Departmental Committee on Energy for consideration and thereafter report to the House.

The Energy Bill 2017, seeks to consolidate the laws relating to Energy, align the legal and regulatory framework of the energy sector with the Constitution of Kenya 2010 by setting out with clarity the specific roles of the National and County Government functions in relation to energy. The Bill proposes to repeal the Energy Act No. 12 of 2006 an Geothermal Resources Act No. 12 of 1982 of Laws of Kenya.

The Petroleum (Exploration, Development and Production) Bill, 2017, seeks to provide a framework for the contracting, exploration and development of petroleum together with production of petroleum discovered within the licensed petroleum exploration blocks. The Bill also seeks to provide a framework for safe cessation of upstream petroleum operations and for connected purposes. The Bill proposes to repeal the Petroleum (Exploration and Production) Chapter 308 of the Laws of Kenya..
Pursuant to Article 118(1)(b) and Standing Order 127, the Committee through an advert on two major dailies on 22nd February, 2018 invited members of the public to submit any representations they may have on the two(2)Bills. Consequently by close of the period for submission of representation, the Committee had received written memoranda’s from a total of nineteen (19) organizations among them representation by County Assembly of Turkana, Turkana County Professional Association , Turkana County Transporters and drivers Group and Turkana Youth Association and the Committee is currently considering them.
in addition to the received written representation, the Committee has scheduled public hearings in five(5) counties namely Turkana, Marsabit, Lamu, Nakuru and Kitui
The objectives of the Public Hearings is to through briefings and discussion sessions:-
1. Provide a platform for local communities who would otherwise not be able to come to Parliament buildings an opportunity to submit their views on the Bills and other relevant subject matters
2. Provide a platform for the many community organization who would otherwise not be able to come to Parliament buildings an opportunity to submit their views on the Bills and other relevant subject matters

The expected outcomes of the Public hearings include: –
1. An in-depth report on the views submitted by the Local Communities regarding the Bills
2. A report of matters raised by the Local communities and organizations on the energy and Petroleum sectors other than the Bill
